Mykola Fedorovych SIYANKO
against Ukraine
(see appended table)

The European Court of Human Rights (Fifth Section), sitting on 7 May 2025 as a Committee composed of:

 Diana Sârcu, President,
 Kateřina Šimáčková,
 Mykola Gnatovskyy, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above applications lodged on the various dates indicated in the appended table,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Mykola Fedorovych Siyanko, was born in 1959. The list of his applications is set out in the appendix.

The applicant’s complaints under Articles 3 and 6 of the Convention were communicated to the Ukrainian Government (“the Government”).

In June and August 2024, the applicant’s representative in application no. 15014/21 informed the Court that the applicant had died (without indicating a date) and that his relatives were unable to continue with the case. She also withdrew from the case due to an alleged conflict of interests.

By letter of 26 August 2024, addressed to the applicant’s wife, the Court invited the applicant’s heirs to confirm, by 15 November 2024, their interest in pursuing application no. 15014/21 and to assign a new representative. According to the information from the tracking system of the national postal operator of Ukraine, that letter was received by the addressee on 10 September 2024. No reply has followed.

By letter of 29 January 2025, addressed to the applicant’s representative in application no. 25275/21 and sent via the Court’s Electronic Communication Service (eComms), the Court invited him to indicate, by 3 March 2025, a person wishing to pursue the proceedings in that application. The letter was not downloaded.

THE LAW

Having regard to the fact that both applications were lodged by the same applicant, the Court finds it appropriate to examine them jointly in a single decision.

In the light of the foregoing, the Court concludes that the applicants’ heirs do not wish to pursue the applications within the meaning of Article 37 § 1 (a) of the Convention.

Accordingly, the applications should be struck out of the list of cases.

For these reasons, the Court, unanimously,

Decides to join the applications;

Decides to strike the applications out of its list of cases.

Done in English and notified in writing on 28 May 2025.
