THIRD SECTION

DECISION

Application no. 5771/23
DYNAMI ZOIS
against Greece

The European Court of Human Rights (Third Section), sitting on 27 March 2025 as a Committee composed of:

 Oddný Mjöll Arnardóttir, President,
 Úna Ní Raifeartaigh,
 Mateja Đurović, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 25 January 2023,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant association, Dynami Zois, is a political entity that participated in the Attica regional elections of 2019. It was represented by Mr V. Sotiropoulos, a lawyer practising in Athens.

The applicant’s complaint under Article 10 § 1 of the Convention concerning a fine imposed on it for sending political material to blind people, after having obtained their addresses and names from the National Federation of the Blind, was communicated to the Greek Government (“the Government”).

By a letter dated 3 March 2025 the applicant association informed the Registry that it wanted to withdraw the application to the Court since it had definitively suspended its functions as a political entity.

THE LAW

In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.

Done in English and notified in writing on 30 April 2025.
