Having regard to the above application lodged on 10 November 2021,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Nikolaos Anagnostakis, was born in 1983. He was represented by Mr A. Anagnostakis, a lawyer practising in Athens.

The applicant’s complaint under Article 8 taken alone and/or in conjunction with Article 14 of the Convention concerning the impossibility for the applicant to lodge an appeal against the decision assigning custody to the mother of the child, whereas the law offered such a possibility to parents who had previously been married, was communicated to the Greek Government (“the Government”).

On 31 October 2024 the applicant informed the Registry that he wanted to withdraw the application to the Court as the continuation of the proceedings would not be in the best interests of the family relationships.

THE LAW

In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
