Having regard to the above application lodged on 16 August 2023,

Having regard to the observations submitted by the respondent Government and the observations in reply submitted by the applicant,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant’s details are set out in the appended table.

The applicant was represented by Ms K.Y. Voronyuk, a lawyer practising in Rivne, Ukraine.

The applicant’s complaints under Article 5 § 3 of the Convention concerning the excessive length of pre-trial detention were communicated to the Ukrainian Government (“the Government”).

THE LAW

In the present application, having examined all the material before it, the Court considers that for the reasons stated below, the applicant’s complaints about the unreasonable length of his pre-trial detention is inadmissible.

In particular, the Court notes that there were sufficient grounds for the applicant’s initial detention, as well as for its subsequent prolongations in view of the existence of a reasonable suspicion of having committed serious offences, as well as due to the risks of influencing witnesses and destroying evidence.

The Court therefore finds that the applicant’s detention was based on relevant and sufficient grounds. It also does not observe any delays on the part of authorities’ while dealing with the applicant’s detention.

In view of the above, the Court finds that these complaints are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 and 4 of the Convention.

For these reasons, the Court, unanimously,

Declares the application inadmissible.
