Until 1980 the applicant• was a practising barrister. He rvas thea

As the ordinary courts jound that they had no jurisdiction to hear aa
appeal against (his decisiou . the applicant appealed to the Visitors oJ the Luts
oj Court. The appeal was dismissed.
Bejore the Connissiou, the applicant complained oJ' the disciplinary
systeni regulatiug the couduct oj banisters in England aad Wales, and alleged
that. iu the circunistauces, he did not hare access to mt intpartial tribunal .
established by law.
The applicant died in 1 98 1 . aud his widow expressed a wish to pursue
the proceedings bejare the Commission .
FINDING OF THE COMMISSIO N
1 . The Commission notes that the applicant died on 21 September 1981
aud that his widow has informed the Commission that she wished to pursue
the application on behalf of her husband . She has submitted that the issues
raised under Article 6(I) in the present application concern questions of
considerable public interest . Furthermore, she states that as the widow of a
person whose reputation has been adversely affected by the disciplinary pro-
ceedings iu questiou, she should be permitted to pursue the application
.
2 . The Governnient on the other hand contend that she has no moral or
material interest at stake in pursuing the application and that the claims made
do not raise issues of general interest and importance concerning the inter-
pretation of Article 6 in relation to professional disciplinary proceedings which
have already been extensively considered by the Commission and the European
Court of Huntan Rights in the cases of Le Compte, Van Leuven and De Meyere
v. Belgium and Albert and Le Compte v . Belgium (see judgments of the Court,
dated 23 June 1981 and 10 February 1983 respectively) .
3 . The Commission recalls that the death of the applicant does not auto-
matically bring the proceedings before the Commission to an end (see e .g .
Applicatiou N° 6166/73 . D .R. 2, p. 66) .
4 . On the other hand, the heirs ot' a deceased applicant cannot claim a
general right to pursue the proceedings before the Commission on their own
behalt' (see Application N° 8261/78 . Kotler v. Italy, Report of the Commission
adopted on 9 October 1982, D .R. 30, p . 5) .
5. The Contmissiou must examine each application in the light of its par-
ticular facts and from the standpoint of whether the applicant's interest at
stake is ot' such a nature that it can be transferred to the heir andfurther
whether consideratious relating to the general interest require the continued
exaniination of the application .

6. In the present case, the applicant was found guilty of professional
misconduct by the Disciplinary Tribunal of Ihe Senate of the Inns of Court
aud the Bar and was disbarred . He complained that the relevant disciplinary
bodies at the Bar did not confornt to Article 6(l) . In particular he submitted
that the Disciplinary Tributial and the Visitors were tiot established by the law
and that the former was neither independent nor impartial . The Contmission
is of the opinion that this complaint is, by its nature, personal to the applicant
aud that his widow-who was not a party to the application-cannot now
claim to have a suflicient legal interest to justifv the continued examination of
the applicatiou on her behall' .
7. Nor does the Comniission consider that there is any question of general
iuterest attectiug the observance of the obligations undertaken by the High
Coutracting Parties which would justify the continued examination of the
application. In this respect it notes that the Commission and Court have pre-
viouslv examined sinrilar issues concerning the conformity of disciplinarv
proceedings with the requirements ot Article 6(1) in many other cases (see e .g .
Le Compte, Van Leuveu and De Mevere and Albert and Lecompte, op . cit.,
and the cases referred to therein) .
8. Moreover the present proceedings concern a system of professional
disciplinarv procedures which, for historical reasons, is peculiar to the Bar of
Euglaud and Wales . The continued examination of the application could not
therefore be justilied ou the basis that important questions of principle
attectiug the observauce ot the Convention bv other High Contracting Parties
are at stake .
For these reasous, the Commission, having regard to Rule 44(1) ot its
Rules of Procedure ,

Les tribunaux ordinaires s'étant déclarés incompétents pour
connaître
d'mr recours contre cette décisiorr, le requérant s'adressa aux Visitors des luns
of Court. Ceux-ci rejetèrent le recours.
Devant la Conrnrission, le requérant se plaiut du système discipliaaire
auquel sont sourrris les barristers eu Aagleterre et au Pays-de-Galles et allègue
u'avoir pas eu accès, eu l'occurrence. à uu tribunal inrpartial établi par la loi.
Le requérant est décédé en 1981 et sa veuve a déclaré vouloir poursuivre
la procédure devant la Commission .

MOTIFS DE LA DÉCISIO N
I . La Commission prend acte du décès du requérant survenu le 21 septembre
1981 et du désir manifesté par sa veuve de maintenirla requête au nom de son
mari décédé. La veuve a soutenu que les questions soulevées sur le terrain de
l'article 6, paragraphe 1, en l'espèce présentent un intérêt général considérable .
Elle estinte en outre qu'en tant que veuve d'une personne dont la réputation a
été ternie par la procédure disciplinaire en question, elle devrait être autorisée
à poursuivre l'affaire .
2 . Le Gouvernement soutient, quant à lui, que la veuve n'a aucun intérêt
moral ou matériel
à la poursuite de l'affaire et que les griefs formulés ne
posent aucun problème d'intérêt général touchant à l'interprétation de l'article 6,
i agissant d'uue procédure disciplinaire de caractère professionnel que la
Commissiou et la Cour européenne des Droits de l'Homme ont déjà longue-
ment examinée dans les aft'aires Le Compte, Van Leuven et De Meyere c .
Belgique et Albert et Le Compte c . Belgique (Voir les arrêts de la Cour en
date du 23 juin 1981 et du 10 février 1983, respectivement) .
3. La Commission rappelle que le décès du requérant ne met pas automa-
tiquemerd tiu à la procédure devant la Commission (voir par exemple
N° 6166/73, D.R. 2, p. 66) .
4. D'autre part, les héritiers d'un requérant décédé ne peuvent revendiquer
le droit général de poursuivre devant la Commission la procédure en leur nom
propre (voir la requête N° 8261, Kofler c . Italie, rapport de la Commission
adopté le 9 octobre 1982, D .R. 30, p. 5) .
5. La Commission doit examiner chaque requête à la lumière des faits
propres à l'affaire et du point de vue de savoir si l'intérêt en jeu est de nature
à passer du requérant à son héritier et si des considérations d'intérêt général
exigent de poursuivre l'examen de la requête .

6. En l'espèce, le requérant a été reconnu coupable de faute professionnelle
par le tribunal disciplinaire des •Inns of Court» et du Barreau et rayé du
Barreau .
Il se plaignait de ce que les organes disciplinaires compétents du
Barreau ne sout pas conformes à l'article 6, paragraphe 1
.
Il
soutenait
notamment que le tribunal disciplinaire et les •Visitors• ne sont pas établis
par la loi et que le premier cité n'est ni indépendant ni impartial . La
Comntission estinie que ce grief est par nature personnel au requérant et que
sa veuve - qui n'était pas partie à l'affaire - ne peut pas prétendre
maiuteuant avoir mi intérêt juridique suftisant pour justifier la poursuite de
l'examen de l'at'l'aire en son nom propre .
7 . La Commissiou n'estime pas non plus qu'une question d'intérêt général .
touchant au respect des obligations souscrites par les Hautes Parties Contrac-
tautes, justifierait de poursuivre l'examen de la requête . Elle relève à cet égard
que la Comntission et la Cour ont examiné des questions analogues relatives à
la conformité d'une procédure disciplinaire avec les exigences de l'article 6,
paragraphe 1, dans bien d'autres affaires (voir par exemple Le Compte, van
Leuveu et De Meyere et Albert et Lecompte, op . cit. et les affaires auxquelles
reuvoient ces deux dernières) .
8. Du reste, la présente procédure concerne un système disciplinaire
professionncl qui . pour des raisons historiques, appartient en propre au
Barreau d'Angleterre et du Pavs-de-Galles . Poursuivre l'examen de la requête
ne se justitierait donc pas par l'idée que se trouvent en jeu d'importantes
questions de priucipe touchant au respect de la Convention par d'autres
Parties Contractantes .
Par ces niotit's, la Comniission, vu l'article 44,
