THIRD SECTION DECISION Application no. 38648/22 M.A. against Greece The European Court of Human Rights (Third Section), sitting on 23 January 2025 as a Committee composed of: Oddný Mjöll Arnardóttir , President , Úna Ní Raifeartaigh, Mateja Đurović , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above application lodged on 3 August 2022, Having regard to the decision to grant the applicant anonymity, in accordance with Rule 47 § 4 of the Rules of the Court, Having deliberated, decides as follows: FACTS AND PROCEDURE The applicant, M.A., was born in 1974. He was represented by Mr G. Dagretzakis, a lawyer practising in Papagou. The applicant’s complaints under Articles 8 and 13 of the Convention of the Convention concerning the failure of the domestic authorities to effectively enforce the court decisions setting the contact schedule between the applicant and his children were communicated to the Greek Government (“the Government”). On 28 November 2024 the applicant informed the Registry that he wanted to withdraw the application to the Court since his contact with his children had progressively been re-established. THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
