FOURTH SECTION DECISION Applications nos. 17441/21 and 14116/23 Ioan RACHIERU against Romania The European Court of Human Rights (Fourth Section), sitting on 5 December 2024 as a Committee composed of: Anne Louise Bormann , President , Sebastian Răduleţu, András Jakab , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above applications lodged on the various dates indicated in the appended table, Having deliberated, decides as follows: FACTS AND PROCEDURE The applicant, Mr Ioan Rachieru, was born in 1958. The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”). On 1 March 2024 a letter concerning application no. 14116/23 sent by the Registry to the applicant returned to the Court with a note from the prison’s representative that the letter could not be delivered because the applicant had died on 10 January 2024. On 13 August 2024 the Registry sent, by registered post, a letter mentioning both applications, to the applicant’s home address, asking whether there was any potential heir wishing to pursue the proceedings before the Court. That letter was received by the applicant’s wife on 23 August 2024. No potential heir contacted the Court to date. THE LAW Having regard to the similar subject matter of the applications lodged by the same applicant, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, the Court concludes that the applicant’s heirs, if any, do not wish to pursue the applications within the meaning of Article 37 § 1 (a) of the Convention. Accordingly, the cases should be struck out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
