THIRD SECTION DECISION Application no. 39978/21 A.R. and F.R. against Greece The European Court of Human Rights (Third Section), sitting on 5 December 2024 as a Committee composed of: Oddný Mjöll Arnardóttir , President , Úna Ní Raifeartaigh, Mateja Đurović , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above application lodged on 10 August 2021, Having regard to the decision to grant the applicants anonymity, in accordance with Rule 47 § 4 of the Rules of the Court, Having deliberated, decides as follows: FACTS AND PROCEDURE The applicants, A.R. and F.R., were born in 1985 and 2010, respectively. They were represented by Ms A. Mullis, a lawyer practising in Lesvos. The applicants’ complaints under Article 3 of the Convention concerning the living conditions and the alleged lack of medical treatment of the applicants (father and his minor son) in Lesvos (on the streets after the fire in Moria broke out and in Mavrovouni Reception and Identification Centre, RIC) were communicated to the Greek Government (“the Government”). The parties were invited to inform the Court of their position on friendly settlement by 18 October 2024. In their letter of 15 October 2024, the applicants’ representative informed the Court that they had lost contact with the applicants. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that the applicants may be regarded as no longer wishing to pursue their application. Accordingly, the case should be struck out of the list. The Court notes that it may decide to restore the application to the list of cases provided that the conditions of Article 37 § 2 of the Convention are satisfied. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 16 January 2025.
